ABSTRACT OF BOOK (to be published on 11/11/18)
This qualitative research identifies over 50 examples of the language of the family court reflecting a violent character, contributing to post-separation family violence, escalating poverty and homelessness. It describes the language and cultural assumptions that family law makes and the devastating impact of its adversarial family court on the family. It shares the 2008 lawyer’s view that family law does not render ‘simple justice’ (Terry Carson: Understanding the family court). It confirms the 2014 researcher’s view that the family court is ‘broken, dangerous, and unprofessional’ (The Glenn Inquiry: The People’s Blueprint). It broadens the 2018 politician’s view that the family court causes ‘harm’ to the family (Stuff Politics: Justice Minister). It echoes the separated parent’s view that the family court is ‘alienating’ (Families 4 Justice) and ‘endangering’ (The Backbone Collective) children. This autoethnography gives a human face to family law and court, that may improve equity outcomes for the family.
